Below you will find the general terms and conditions of our huma-i.eu online shop

These provisions regulate the contracting of products and services offered and direct advertising to its customers / users by Smartcare Services S.L. and its online portal huma-i.eu. These General Conditions also regulate the rights and obligations of the parties deriving from the purchase and sale transactions concluded between them.

These conditions are set for all users / customers of the huma-i.eu website and they are obliged to know and accept them in order to make any purchase or consultation on the website.

Huma-i reserves the right to modify these conditions without notice. The changes will be effective from the date of publication on this page and will not be retroactive.

These general conditions bind the user / customer to Huma-i when purchasing any type of product or service through the huma-i.eu website. All this in accordance with the provisions of art. 1.255 of the Civil Code. Valid in all respects when the user accepts these conditions of his own free will during the purchase process and / or using any of the services offered by huma-i.eu.

These conditions are formulated with the intention of communicating and protecting the rights of users and customers in accordance with the law 7/98 of April 13 regarding General Contract Conditions, the law 7/96 of January 15 regarding Retail Trade Regulations, the Civil Code, Directive 2000/31 / EC of the European Parliament and of the Council of 8 June, Law 34/2002 of 11 July on information society services and electronic commerce , the Royal Legislative Decree 1/2007 of November 16, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users and other complementary laws and their implementing regulations.

Huma-i, in accordance with the provisions of art. 10 of Law 34/2002 of 11 July, through its website and these General Conditions, provides access to all contact and registration information of the company, as well as the modification and revision of customer data with a protected system that guarantees privacy.

2. User / customer conditions

All users have the right to public and free access to all information on the website. Huma-i reserves the right to limit access to information and articles, for commercial or promotional reasons, to registered users.

All public information on the huma-i.eu website, such as trademarks, products, logos, images, texts, etc., of the companies offered are protected by copyright and used with the consent of their owners. The images and texts in the huma-i.eu catalog are protected by copyright and are subject to the respective copyrights. The misappropriation of such content for commercial purposes will be reported to the respective bodies responsible for the protection of registered content protected by copyright.

In no case is the copying, reproduction or transfer of data by users or third parties authorized without the express authorization of huma-i.eu in the terms indicated in section XI on Industrial and Intellectual Property Rights. All users must provide all mandatory and necessary data for the formalization of the purchase of our products and services.

Users can contract and place orders only if they are of legal age (minimum 18 years), or otherwise with the express authorization and acceptance of responsibility by their parents or legal guardians.

All data communicated by the user / customer are provided voluntarily and Huma-i guarantees that they will not be disclosed and that they will be handled correctly and safely.

Any information provided fraudulently or falsely or with malicious intent or unfair competition can be considered as a crime of false documents.

3. Offer and Acceptance

3.1 Prices

Huma-i reserves the right to change the prices of its products and services offered in the catalog at any time and without notice, the change will not affect the prices on orders already placed. These prices will be valid from the time of their publication and will not be retroactive, guaranteeing the customer that the price in force will be the one applicable at the time the order is formalized and the secure payment is processed.

All products include detailed information on their characteristics, warranty period, satisfaction guarantee, delivery time, branding and a sample photo.

All prices indicated in Huma-i are expressed with taxes and shipping costs included, only any additional discounts through coupons or specific promotions, and handling / management costs before shipping are excluded.

The price of the products is inclusive of VAT.

3.2 Order acceptance

Once the acceptance of the purchase conditions has been confirmed, all the data filled in and the confirmation button clicked, Huma-i will inform the user / customer of the conditions of his order by e-mail or post.

Delivery times are linked to the stock of the products purchased and the customer will be informed of their status at any time.

3.3 Shipping

Orders placed on huma-i.eu will be delivered to the address set by the customer / user at the time of the order in any country of the European Union and UK. It is possible to change the delivery details only before the goods leave our warehouse and only if it does not alter the contractual conditions, in which case it may involve additional costs.

All deliveries are made by a transport company, accompanied by the corresponding documentation which must be checked and confirmed by the customer.

Orders are covered by insurance for 100% of the value of the goods.

Important: check that the outer packaging of the packages received is in good condition.

Otherwise, write down any anomalies on the delivery note, refuse the shipment and communicate it in writing to the following e-mail address: info@huma-i.eu or by calling the customer service number +34 872723214 as soon as possible. All complaints due to transport damage should be reported to Huma-i as soon as possible. Remember never to throw away the packaging of the products before having checked that they are in perfect condition and have checked that all the items correspond to those you ordered.

Deliveries to the Balearic and Canary Islands are subject to analysis and quotation as they may involve additional costs.

The couriers will deliver from Monday to Friday based on your geographical location (also depending on the delivery route established for your city), arranging an appointment with you before delivery. If your area is far from a large urban center or city, or has fewer than 5,000 inhabitants, the delivery may be delayed by up to 10 working days with respect to the delivery deadline.

Occasionally, for reasons beyond Huma-i's control, delivery times may be delayed by 7 working days from the expected delivery date. In this case, the buyer can cancel the order and get back the amount paid.

Failure to deliver is not considered as such if it has been deliberately delayed or if the buyer could not be reached by phone or email to confirm the delivery date of the goods.

4. Withdrawal

Right of withdrawal. As a consumer and user, you have a period of 14 calendar days to exercise your right of withdrawal. The useful period to return the order is calculated starting from the receipt of the same. The customer can return the products as long as they are in perfect condition and have not been used. To return the purchase, the customer must complete the following withdrawal form and return it signed to the e-mail address info@huma-i.eu or to the postal address that appears in the Withdrawal Form.

4.1 Different ways to exercise the right of withdrawal

To exercise your right of withdrawal, you can send your request for withdrawal using the form in section 4 or return the products to the following address: Calle Sant Antoni 65, bajos 17600 Figueres, Gerona, Spain.

In the event that a transport service is requested for the return of the product, the costs of this service will be deducted when the money is returned.

The item must be delivered in perfect condition as well as all its original components and in the event that it is not returned in its original packaging it could suffer depreciation.

The exercise of the right of withdrawal gives rise to the reimbursement of the sums paid by the consumer within a maximum period of 14 calendar days from the exercise of the aforementioned right and from the receipt of the goods.

The refund will be made through the same payment method selected by the customer at the time of the order.

In case of wear or deterioration of the goods for reasons that are not exclusively due to its testing in order to make a decision on its final purchase, Huma-i may agree with the customer the corresponding compensation proportional to the deterioration.

4.2 Exceptions to the right of withdrawal

The right of withdrawal does not apply to contracts relating to:

The supply of sealed goods which are unsuitable for return for health protection or hygiene reasons and which have been opened after delivery.

Contracts for products made to measure for the consumer and user or which have been clearly personalized, or which, by their nature, cannot be returned or are liable to deteriorate.

Pursuant to Article 102 (exceptions to the right of withdrawal) products with special sizes manufactured specifically for the customer will not be exchanged or returned, except for those with manufacturing defects. A product is considered to have a special measure when it is not available for direct sale on the website and is made at the customer's request.
